Introduction

Ben Graham and/or Ben Graham Fitness Solutions, Inc. (“we,” “our,” or “us”) is committed to protecting your privacy. This Privacy Policy explains how your personal information is collected, used, and disclosed by Gradux, our fitness tracking application (“Gradux” or the “App”).

This Privacy Policy applies to all users of Gradux and by using our App, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree with our policies and practices, do not use the App.

Information We Collect

Personal Information

When you register for and use Gradux, we collect the following categories of personal information:

  • Account Information: Email address, first name, last name, and username
  • Profile Information: Age, country, weight class, and profile pictures (if provided)
  • Fitness Data: Body composition statistics, workout tracking data including weights used, repetitions completed, and other training-related metrics

How Information Is Collected

  • Information You Provide: Most information is collected directly from you when you create an account, set up your profile, or input workout data.
  • Automatically Collected Information: Some technical information may be automatically collected when you use our App, such as device information and usage patterns.

How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve the App and its features
  • Create and maintain your account
  • Process and track your workouts and fitness progress
  • Enable the social features of the App, such as sharing workout data with the community under your username
  • Respond to your comments, questions, and requests
  • Monitor and analyze trends, usage, and activities in connection with our App
  • Detect, prevent, and address technical issues
  • Comply with applicable laws, legal processes, and regulations

Community Features and Data Sharing

Gradux includes community features that allow users to share certain fitness data with other users. By default:

  • Your workout data is shared under your username (which does not need to be personally identifying)
  • Your data is categorized by weight class, age group, and country
  • You can choose to obscure certain data from other users

We have designed these features to make it difficult for someone to identify you personally. For example, you might appear as “GuitarLover232 from Sweden in Men’s Open 205 lb Class.”

Third-Party Advertising

Gradux displays advertisements through Google AdMob. While we do not directly share your personal information with AdMob, they may collect certain information as described in their privacy policy. We encourage you to review Google AdMob’s privacy policy for more information about their data practices.

Data Storage and Security

We store your personal information on Firebase, a cloud service provided by Google. We implement appropriate technical and organizational measures to protect your personal information against unauthorized or unlawful processing, accidental loss, destruction, or damage. These measures include:

  • User authentication via Firebase
  • Secure communications
  • Access controls to limit who can access your information

However, no method of transmission over the Internet or electronic storage is 100% secure, so we cannot guarantee absolute security.

Your Rights and Choices

Account Information

You can review and update your account information through the App’s settings.

Deletion Rights

You can request deletion of your account and associated data through the user settings section of the App. Upon request:

  1. Your data will be held for 30 days
  2. A countdown will be displayed allowing you to cancel the deletion request
  3. If not canceled, your data will be permanently deleted after the 30-day period
  4. If you cancel and then immediately request deletion again, another 30-day waiting period will begin

Children’s Privacy

Gradux is intended for users aged 17 and older. We do not knowingly collect personal information from children under 17. If we discover that a child under 17 has provided us with personal information, we will promptly delete such information.

International Data Transfers

While Gradux is currently primarily directed at users in North America, we may store and process your information in any country where we have facilities or service providers. By using Gradux, you consent to the transfer of information to countries outside your country of residence, which may have different data protection rules.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time. The updated version will be indicated by an updated “Last Updated” date and the updated version will be effective as soon as it is accessible. We encourage you to review this Privacy Policy frequently to be informed of how we are protecting your information.

Your California Privacy Rights

While Gradux is not currently specifically targeted at California residents, we recognize the rights granted to California consumers under the California Consumer Privacy Act (CCPA) and similar laws. If you are a California resident, you may have certain rights regarding your personal information, including:

  • The right to request deletion of your personal information
  • The right to opt-out of the sale of your personal information (note: we do not sell personal information)

Dispute Resolution

Any disputes arising from or relating to this Privacy Policy or your use of Gradux shall be governed by the laws of Ontario, Canada, without regard to conflict of law principles. You agree that any legal action or proceeding between you andBen Graham and / or Ben Graham Fitness Solutions, Inc. shall be brought exclusively in the courts located in Ontario, Canada, and you hereby consent to the personal jurisdiction and venue of such courts.
